1. Agreement to Terms

By accessing or using the GalleryNet mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the App.

These Terms constitute a legally binding agreement between you and GalleryNet Holding B.V., a company registered in the Netherlands with KvK number 96815361, located at Oostenburgergracht 27 3, 1018 NA Amsterdam, Netherlands ("GalleryNet", "we", "us", or "our").

2. Eligibility

You must be at least 17 years of age to use the App. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Registration and Security

3.1 Account Creation

To use certain features of the App, you must create an account by providing a valid phone number. You will receive a one-time password (OTP) via SMS to verify your identity.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@gallerynet.net of any unauthorized use of your account.

3.3 Account Information

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

4. Use of the App

4.1 License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use.

4.2 Permitted Use

You may use the App to discover art galleries, exhibitions, and events; follow galleries and organizations; save artworks to your personal collection; RSVP to exhibitions and events; message galleries and organizations; share content with others; and use location services to find nearby galleries and events (optional).

4.3 Prohibited Conduct

You agree not to:

• Use the App for any illegal purpose or in violation of any applicable laws
• Impersonate any person or entity
• Upload or transmit viruses or any other malicious code
• Attempt to gain unauthorized access to the App, other users' accounts, or our systems
• Use automated systems (bots, scrapers, crawlers) to access the App
• Interfere with or disrupt the App or servers connected to the App
• Harass, abuse, threaten, or intimidate other users
• Upload, post, or transmit any content that is unlawful, defamatory, obscene, pornographic, or otherwise objectionable
• Collect or store personal data about other users without their consent

5. Content

5.1 Gallery and Organization Content

Content on the App, including artworks, exhibitions, and events, is uploaded by verified galleries and organizations. GalleryNet curates content to ensure quality and appropriateness but does not claim ownership of content uploaded by galleries and organizations.

5.2 Artistic Content Policy

The App may display artistic content, including artistic nudity, in a professional art context. Such content is presented for educational and cultural purposes. Pornographic content is strictly prohibited.

5.3 User-Generated Content

You may create content through comments, messages, and other interactions. You retain ownership of any content you create, but you grant GalleryNet a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute such content in connection with operating and promoting the App.

5.4 Content Reporting

You may report content that violates these Terms or our Community Guidelines. We review all reports and may remove content or suspend accounts that violate our policies.

6. Intellectual Property Rights

6.1 GalleryNet Property

The App, including its design, features, text, graphics, logos, and software, is owned by GalleryNet and protected by copyright, trademark, and other intellectual property laws.

6.2 Third-Party Content

Artworks and other content uploaded by galleries and organizations remain the property of their respective owners. You may not use such content without permission from the copyright holder.

7. Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to our collection and use of your information as described in the Privacy Policy.

8. Location Services

The App may use your device's location services to provide nearby galleries and events on the map feature. Location access is optional and can be enabled or disabled in your device settings.

9. Fees

The App is free to use. Event listings may display ticket prices set by galleries and organizations. GalleryNet does not process payments or sell tickets directly.

10. Disclaimers and Limitation of Liability

10.1 "As Is" Basis

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10.2 Limitation of Liability

To the maximum extent permitted by law, GalleryNet shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues resulting from your use or inability to use the App.

In no event shall GalleryNet's total liability to you exceed one hundred euros (EUR 100).

11. Indemnification

You agree to indemnify, defend, and hold harmless GalleryNet, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of third parties.

12. Termination

12.1 Termination by You

You may delete your account at any time through the App settings. Upon deletion, your account and associated data will be removed in accordance with our Privacy Policy.

12.2 Termination by Us

We reserve the right to suspend or terminate your account and access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms, is harmful to other users, or is fraudulent or illegal.

13. Modifications to Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any disputes arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the competent courts in Amsterdam, the Netherlands.
